  • They do it because it works. Not only does it lead to more direct sales, but the app is scraping data that can be further used to generate sales, either to the user directly or sale of their data to third parties. And people who don’t like their habits being gamified will simply not install the app.

    How many people are going to say “I refuse to go to Dunkin because they went too far gamifying their rewards program in their shitty app I never use”? Probably close to zero. So, the cost of doing it is whatever they pay their offshore contractors, who probably can’t afford to come visit the US, much less go to Dunkin for awful coffee every day.

    Yup, this is the problem right here. Investments are supposed to generate returns, that’s the whole point. But Milton Friedman and Jack Welch decided that the sole mission of any company was to increase shareholder value, and the rest of the world rolled with that. So whenever these CEOs point to their Mission and Vision statements, unless they say “Our only priority is delivering returns to our Shareholders”, they are lying.

    Economist Milton Friedman introduced the Friedman doctrine in a 1970 essay for The New York Times, entitled “A Friedman Doctrine: The Social Responsibility of Business Is to Increase Its Profits”.[5] In it, he argued that a company has no social responsibility to the public or society; its only responsibility is to its shareholders.[6]

    Meanwhile, we’ve decided that these corporations are people. Psychopaths who have no moral responsibilities to anyone but their shareholders, but people nonetheless.


  • Hey, there’s a key difference with this case vs. all the other cases. It’s a civil lawsuit that Trump instigated. So he is the plaintiff here, he is on the offense in the lawsuit. Shouldn’t he want to give his side of the story? And if he delays this one, wouldn’t the judge be well within their rights to say “If you can’t tell us what he did that warrants a penalty, shouldn’t we just drop all this”?

    And actually, I think this is the outcome Trump wants. He doesn’t want to actually win this. He wants the judge to throw it out for entirely sane reasons, because it’s one more thing to complain about and he knows his followers won’t look into the key differences between this and other cases.

    If your only platform is grievance, you need new grievances to keep things fresh, even if you manufacture them yourself.
